Regular Meeting Minutes

Call to Order: 7:01 pm by Mayor Nathanael Dinsmore

Pledge of Allegiance: Led by Mayor Nathanael Dinsmore

Roll Call: Present – Hijar, Dinsmore, Willis, Schiro, Massey, and Town Attorney Nathan Shultz. Not Present – Paul and Roberts

Approval of Minutes: Motion to approve minutes dated 12/01/2021 made by Willis, 2nd by Hijar, motion carried with two absent.

Executive Session: None

Public Comment: Ashley Petty: Curious how things are coming with the water bill situation? Mayor: We got last months bills out, we are not doing any late fees and let everyone do a payment plan deal. Waiting for QuickBooks to contact and get everything transferred from the old program into the new program. Petty: Have the water meter readings been turned yet? Mayor: Yes, Eric stated they have been read and uploaded into the system.
Mark Cloer: It is not a statute, but it is a tradition of this town council when a trustee continues to miss after the third time they are asked to resign. Do you plan on doing that tonight with Mr. Roberts and if not why not? Shultz: Depends on if it is an excused absence. Discussion over number of meetings a trustee can miss before they are asked to resign.
Tony Moreland: Would like to purchase an older tote, one that you don’t use. Willis: How much do they go for? Discussion over cost of used totes. Dinsmore: We can sell one for $20.00.

Clerk: Secom called; we are past the disconnect date on the phone bill.  $142.93. Can it be paid via phone tomorrow? Willis: Yes.
Flags go up down Colorado Street. Be sure to add Juneteenth, 19th of June.
Discussion over bills. Massey: Need to order 4 20lb fire extinguishers for Trash truck.
Motion to purchase 4 20lb fire extinguishers for trucks made by Willis, 2nd by Massey, motion carried, two absent.
Discussion over landfill bill. Decision to contact landfill and bank to verify bill.
Chubbuck’s stated the ranger needed a clutch slave cylinder; the cost is $540. Discussion over cost. Decision made to hold till Mayor contacted Chubbuck’s and asked questions.
Chubbuck’s also asked when they could come pick up the used motor oil. Decision they could come when they could get here.
Sandy Johnson ordered a 2 yd and was billed a 4 yd. Would like to be billed for what ordered and credited for mistake. Verify that with Trash supervisor then credit if correct. Bill for what is ordered not what they receive and keep track of what needs to be changed out and change as soon as we can.
Court dates for 2022; one falls on a day the office is closed; Veteran’s Day. Decision made to go a week later.
CRW annual conference & exhibition coming up March 7 thru March 10. Tabled.
Sanitation: Truck 7 no price yet, the power take-off/u-joints going bad. Discussion over truck 7. Truck 2 has a hydraulic leak where the line goes in, that will have to be repaired real soon. Discussion over truck 2 warranty.
Order 8/10 tires as a set for the year, instead of piecemeal. Discussion over ordering tire in bulk.
Motion to purchase eight tires for $3200 made by Hijar, 2nd by Massey, motion carried, two absent
Driver Tim Vallejos is just short of his 90 days, he is doing an excellent job; suggest that he goes from $14 to $16 an hour as well as start receiving his benefits package.
Driver Fernando Dela Torres is receiving $16 would like to see him go up $.50 to $16.50.
Motion to increase Tim rate of pay $16 and give benefits package, as well as increase Fernando $.50 on his rate of pay made by Willis, 2nd by Massey, motion carried, two absent.
Code Enforcement: Mr. Bandimere donated an old Beat wagon; used at the National Sugar Factory, would like to donate to place it at Tent City. Would like to purchase a sign thanking him and give a brief history of Sugar City.
Motion to purchase sign for Tent City not over $50 made by Willis, 2nd by Schiro, motion carried, two absent.
Colorado Association of Code Enforcement Officers put out; the time between the beginning of Dec and the end of Jan is what the State considers family time. They put out to all Code Enforcement Officers that this is the non-proactive time. Have not been out proactively, because most people are out of town due to holiday season. Been doing a lot of training currently. One ticket for dog at large on Misty Fox. Discussion over court. Decision made to carry over ticket till next month.
Going through ordinances few days and found one that the town should utilize. Trees that are dead and this ordinance states that we can notify them, and they have 60 days to do the work, then we can go in and take it down and bill them for the work. Discussion over tree removal. Discussion over liability.
Been here for over two years and was wondering if I could get the benefits package? Discussion.
Motion to make Robert up to 32 hours a week and benefits package made by Willis, 2nd by Schiro, motion carried, two absent.
Schurr Thing Construction – 201-207 California bought 6 lots, they are needing the approval of building permit.
Motion to approve the building permit after proof of payment has been established made by Massey, 2nd by Hijar, motion carried, two absent


NEW BUSINESS: Opoid settlement Shultz: The county took over and you need to sign the MOU. Discussion over Opoid settlement and county.
Black Hills- Discussion over old franchise fee and new franchise fee. There is no percentage in the new franchise rights. Tabled.
Reece: Can I bring a propane tank into town? Discussion over propane. Decision made that propane tanks are not authorized in town limits.
Cloer: Do we have an active planning and zoning board? Would like to join. Decision made to let him know when we get a board together.
