REGULAR MEETING MINUTES
09/15/2021

CALL TO ORDER: By Mayor Dinsmore at 7:01 PM
PLEDGE OF ALLEGIANCE: Led by Mayor Nathaniel Dinsmore
ROLL CALL: Present: Mayor Dinsmore, Mayor Pro- Tem Willis, Trustee Massey, Trustee Roberts and Trustee Paul, Trustee Hijar and Town Clerk Julie Sandoval. Trustee Schiro absent.

Approval of minutes from 09/01/2021.
Motion by MPT Willis to approve the minutes for 09/01/2021.
Second by Trustee Roberts

Public comments:
Tanya Cloer approached the council concerning the court cost she was expected to pay, she stated that no decision was made thus far. Trustee Paul stated that the council does not have the authority to dismiss court decisions. Mrs. Cloer told Trustee Paul he was new here and did not know what he was talking about. Trustee Massey stated that “we should dismiss her court fees and from now on stay the hell out of it from here on out”, but since they previously stated they would dismiss her court cost then the council should stick to their word and dismiss her court cost. Mr. Schultz stated that they could rectify the situation and move forward. The council decided to dismiss the court fees and move forward.
Mr. Cloer addressed the council concerning Mr. Tooker moving his fence back closer to the other fence by the yard. Mr. Tooker proposed moving the fence back 2 feet and having the maintenance guys take the fence down and move it back and replace it closer to the Cloers yard, also promising he (Mr. Tooker) would maintain the parking so no one parks over on that side, and Mr. Tooker promised he would clean up any trash that would build up on that side of the fence. Mr. Cloer stated he wanted this proposal in writing and if Mr. Tooker no longer works for the town that the town would continue to pick up the trash if the council agreed. Mr. Cloer also stated that the bushes in the fire lane at Mr. Del Rio’s property and some other places around town. Mr. Tooker stated he has spoken to Mr. Del Rio and he does not care if the town goes in and takes the bushes out. MPT Willis questioned how many men hours Mr. Tooker thinks it will take to redo the Cloers fence. Mr. Tooker replied 4-6 hours with 2 men and the right equipment.
Trustee Paul thanked the Cloers for holding the town accountable for their actions. Mr. Tooker also stated he would like to get some no parking signs.
Trustee Massey questioned Mr. Tooker about the trash that blows in his yard from the same people and questioned who would be cleaning up his trash now if they are cleaning up the Cloer’s side of yard? Trustee Roberts questioned the same thing, what about all the residents that get trash blow in their yards where is it fair to pick up one person’s trash on the side yard but not for everyone? Trustee Massey stated we need to deal with and fix the problem from where the trash is coming from. Mr. Tooker stated he personally seen Wendell McNeal son throw trash out of his window and that Mrs. McNeal has been ticketed for her trash and will continue to be ticketed for the accumulation of trash causing issues.
Trustee Paul made a motion to approve the man hours to move back the fence and maintain the grass and mowing on that side of fence and to keep the trash cleaned up in the water drainage ditch and the Cloers will be responsible for any trash on their property and code enforcement will continue to follow up on tickets.

REPORTS:
The Clerk Mrs. Sandoval discussed having the safe ready to use and questioned where the council would like for it to be mounted.
Mrs. Sandoval also reported with the progress on UBMax, explaining that the program was now up and running.
Mrs. Sandoval explained she had an appt in Colorado Springs with one of her kids on Monday Oct the 4th, and she would need the day off. MPT Willis questioned Mr. Tooker about covering in the office for Mrs. Sandoval, Mr. Tooker agreed.
The clerk report also included Frances De Herrera’s past water bill, some discussion was done concerning this matter and it was agreed that it stated on the bill clearly what was being paid for and so no adjustments would be made to Mrs. De Herrera’s bill.

Mr. Tooker stated that some of his report was already addressed in the public comments. However, he did have a few other items to report on. Mr. Tooker stated he had been in contact with Black Hills Energy and the streetlights around town had been reported and they should all be fixed by Friday. Mr. Tooker questioned when the fence would be able to be put back up at south park? Trustee Massey explained it would not be long they just needed to add some dirt in the park. One of the town maintenance crew suggested putting up cons to keep people from parking in the park.
Mr. Tooker asked for a set of keys to the office for after hour access. Trustee Roberts stated he did not believe Mr. Tooker needed access to the office after hours. Mayor Dinsmore instructed Mr. Tooker to call himself or MPT Willis if he needs in the office.

Old Business:

New Business:
Nathan Schultz introduced himself to the council and provided the town with a proposal if the town decided to hire him as the new town attorney. Mr. Schultz stated that anyone of the council may contact him with questions as well as the town clerk, he also stated that he would prefer phone calls rather than texting. Mr. Schultz stated he would respond to a text but would prefer a phone call.

Trustee Paul explained he would like a notice in who speaks with the attorney when and about what. Mr. Schultz stated the invoice would specify who he speaks with and will have a short explanation.
Trustee Roberts made a motion to hire Mr. Schultz as the new town attorney.

MPT Willis made a motion to approve the bills in the amount of $16,926.93.

TRUSTEE COMMENTS
Trustee Massey announced some information concerning the fuel tank 1000-gallon tank for $2,500.
Trustee Massey made a motion to have the gas company do a pre-purchase inspection on the gas.

Trustee Roberts discussed Valley Oil putting dyed fuel in our tanks. Trustee Roberts questioned why we stopped getting fuel at Bens Gas House and went to Valley Oil? MPT Willis suggested it had to do with being charged taxes on our fuel. Trustee Roberts mentioned being allowed to investigate it, the council agreed.
MPT Willis suggested having a phone poll done concerning changing fuel providers.

Trustee Roberts stated we needed to buy some tote lids.
The council discussed the issue.
Trustee Roberts made a motion to purchase 100 tote lids and 25 of each dumpster lid.

Some discussion was done concerning a town marshal. MPT Willis suggested hiring a town marshal for approximately $20.00 an hour at around 3 days a week.

Trustee Roberts mentioned that truck # 5 needed tires and truck # 7 needs rear brakes, Trustee Roberts suggested taking the truck to McCandless to get it fixed and purchasing 3 new tires for the new truck.
Trustee Roberts announced he has been talking to a gentleman from Home Line security Named Brent Dillanger concerning the security system for the office the wells and a new DVR. Trustee Roberts reported that the gentlemen should be sending some quotes to the town email.

Trustee Massey would like to get a nice grill for the south park he gave a quote of between $600 and $800 dollars for the grill.
MPT Willis made a motion to approve a grill for the south park between 600 and $800 dollars.

Trustee Roberts ask Trustee Massey About the pumps with the floats on them. Trustee Massey stated the pumps are between $260 and $270 dollars and he just needed to know the size of hose.
Trustee Roberts made a motion to have Trustee Massey order 2 pumps with floats and 2 switches for them allowing up to $700 dollars for the cost.
